A rough timeline on the process to obtain Probate and for an Estate to be administered and finalised is set out below:
Obtaining the Death Certificate - 1 month from date of death
Notifying of intention to apply for Probate - 1 week from obtaining the Death Certificate
Writing to and receiving responses from asset holders and creditors - 1.5 months from obtaining the Death Certificate
Signing Application for Grant of Probate - 1 to 2 weeks from obtaining responses from asset holders and creditors
Receive Grant of Probate - 2 weeks from application being lodged
Writing to and redeeming assets of Estate - 1.5 months from receiving Grant
Paying creditors and debts of the Estate - 1.5 months from receiving Grant
Distribution of the Estate - 6 months from the date of the Grant of Probate (or earlier if requested by Executor)
Once Probate has been granted, settlement for the sale or transfer of any property owned by the deceased can occur. This conveyancing process can take some time depending on many factors which are out of the control of the Executors or their solicitors.
As you will see, Probate and administration of an Estate is not a quick process. You should allow approximately one year from the deceased’s death for an average Estate to be finalised.
