What the TAC
won’t cover

The TAC does not cover loss or damage to your vehicle or non-medical personal items. 

The key steps in your TAC claim

  • We’ll meet with you to understand your situation, explain the types of claims available (impairment benefits or common law), and guide you through our No Win, No Fee arrangement. You’ll leave knowing exactly what to expect and how we’ll investigate your claim. Contact our Client Services team to book your free appointment here.

  • We collect all relevant evidence about the accident circumstances, including your TAC file, medical reports, financial records, police records and witness statements.

  • We'll arrange for you to attend independent medical assessments to document your injuries. We’ll review the results with you and provide clear guidance on the next steps for your claim.

  • If the evidence supports your case, we’ll lodge the appropriate application, whether an impairment benefit, Serious Injury Application / Common Law damages claim, or both, on your behalf.

  • We handle discussions and negotiations with the TAC, including informal conferences where your claim can often be resolved efficiently and fairly.

  • If a settlement isn’t possible and your claim is strong, we’ll prepare and lodge Court documents. The Court encourages attempts at resolution, including mediation, and only if necessary will your claim proceed to a hearing, though most cases are settled before reaching this stage.

Our fees explained

We understand that one of the biggest concerns for those injured in a motor vehicle accident is having to pay for legal costs. Here’s how our fees work.

Free initial appointment: Meet with one of our lawyers to discuss your situation and understand your options, with no obligation.


No Win, No Fee:  If we believe your claim has a reasonable chance of success, we'll offer to act for you on a No Win, No Fee basis. This means you won't pay any of our professional fees unless your claim is successful.  


Transparent disclosure: We’ll provide full disclosure of our legal fees and expenses, how much you can expect the TAC to contribute towards your legal fees and an estimate of the likely costs if your claim succeeds. We’ll also explain any potential out-of-pocket expenses if your case isn’t successful. We’ll always be honest about your chances.


Disbursements: Expenses such as medical reports and assessments can be covered by us until your claim is finalised. Depending on the nature of your case, we can claim repayment for these expenses directly from the TAC.

Here’s how to get started.

Step 1: Get medical care

Your health comes first. See a doctor, visit the hospital, or speak with a specialist as soon as possible. Medical records are vital for your recovery and for supporting your TAC claim. Be sure to follow your doctor’s advice and keep all records of treatment.

Step 2: Report the accident to police

Whether police attended the scene or not, make sure the accident is formally reported, either at the scene or at your local station. A police report is an important piece of documentation for your claim.

Step 3: Lodge your claim

Once you've received medical care and reported the accident, you can lodge your TAC claim online or by phone. You'll need to provide details about the accident, your injuries, and any supporting documents. This must be done within 12 months of the accident to avoid complications.

What happens after you lodge a TAC claim?

If your claim is accepted:

You may be eligible for support to help with your recovery. This can include payments for medical treatment, loss of earnings, and other entitlements depending on your situation. We can help with the next steps. 

If your claim is rejected:

You still have options. It’s possible to dispute the decision by lodging a Dispute Resolution Application with the TAC. However, it’s important to seek legal advice first to make sure you’re taking the right steps.

FAQs: Your questions answered

  • You might be eligible to make a TAC (Transport Accident Commission) claim if you fall into one of the following categories:

    • Drivers or passengers injured in a car or motorcycle accident.

    • Pedestrians hit by a vehicle.

    • Cyclists involved in a collision with a vehicle (or even if they swerved to avoid a vehicle and crashed).

    • Public transport users injured on trams, trains or buses.

    • People injured while travelling for work or in the course of employment.

    • Family members or dependants of someone who has died in a transport accident.

    Even if the accident was your fault, you may still be entitled to benefits under the TAC scheme.
